OpenSeizureDetector Privacy Policy V2.1 (March 2022)

This privacy policy governs your use of the software application OpenSeizureDetector (“Application”) for mobile devices that was created by Graham Jones. The Application is a Tonic Clonic epileptic seizure detector (running on a smart watch) and an Android Alarm / Carer alert system.

The Privacy Policy is a requirement of inclusion of the App on Google Play Store.

What information does OpenSeizureDetector obtain and how is it used?

User Provided Information

OpenSeizureDetector obtains the information you provide when you edit the settings on the Android App, or subscribe to the Data Sharing system to record seizure data. (Use of the Data Sharing system is not a requirement to use OpenSeizureDetector).

The only personal information collected by the App is the list of mobile phone numbers entered for SMS alerts, anything typed in the SMS message text and if you have enabled SMS alerts, your location, which is included in the SMS text messages. If you choose to register for updates on the OpenSeizureDetector.org.uk web site, you email address will be recorded, but this is not linked to any data obtained by the App.

The Data Sharing system records personal information such as name and email address. It may in the future ask for age and relevant medical information that may be of use in interpreting your seizure detector data to allow us to develop improved seizure detection algorithms. The data recorded on the Data Sharing system includes accelerometer, heart rate and Oxygen saturation data recorded by the smart watch used for OpenSeizureDetector, and details of the watch being used.

We may also use the information you provided us to contact you from time to time to provide you with important information, software updates or to request information about the data recorded by the Data Sharing system.

Automatically Collected Information

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

This information is only shared with the OpenSeizureDetector teams if the app crashes and you choose to submit a crash report.

Does the Application collect precise real time location information of the device?

If you enable SMS alerts within the application, it uses GPS (or other similar technology) to determine your current location in order to include this in the SMS alert message. Your location is only shared with the mobile phone numbers you enter into the app settings as carers’ contact numbers.

The OpenSeizureDetector authors have no access to your location, so will not share your current location with other people.

If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.

Do third parties see and/or have access to information obtained by the Application?

Yes – data submitted to the Data Sharing system will be made available to other researchers in an anonymised way so that the data cannot be traced back to the user who generated it.

Yes – if you select SMS alarms in the settings, your location will be shared with the phone numbers you enter into the app for people to be notified if the app detects a seizure.

No other data will be shared with third parties.

What are my opt-out rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

If you wish your email to be removed from the web site notification list, please contact graham@openseizuredetector.org.uk.

You can cease to upload data to the Data Sharing system by logging out of the system using the App menu.

Data Retention Policy, Managing Your Information

Your email address is retained if you subscribe to web site updates. This will be retained until you inform us you wish to opt out. Your email address will not be shared with third parties.

Seizure detector data and the personal information associated with it that is recorded to the Data Sharing system will be retained indefinitely.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at graham@openseizuredetector.org.uk. We will delete such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. Your email address used to subscribe to web site updates is only visible to site administrators.

Information provided in crash reports is only available to developers.

Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email (if you subscribe to email updates). You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United Kingdom.
